These Terms of Service ("Terms") govern your use of the websites, apps, games, and services offered by EcoEarth Enterprises, Inc. and its brands, Mushy Marketing, EcoEarth, and EcoStore (together, the "Services").
1. Who we are
The Services are provided by EcoEarth Enterprises, Inc. ("EcoEarth Enterprises," "we," "us"), a Delaware corporation based in Austin, Texas.
2. Acceptance of terms
By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you agree on its behalf and confirm you have authority to do so. If you do not agree, do not use the Services.
3. Eligibility
You must be at least 18 years old, or the age of majority where you live, to use the Services or make a purchase.
4. Accounts and security
You are responsible for the accuracy of your account information, for keeping your credentials and API keys secure, and for all activity under your account. Tell us promptly at [email protected] if you believe your account has been compromised.
5. Subscriptions, renewal, and billing
- Paid subscriptions, including Mushy Marketing plans, are billed in US dollars (USD) in advance for each billing period.
- Subscriptions renew automatically at the end of each period until you cancel.
- We may change prices. We will give you advance notice of any price change, and it will apply from your next billing period after the notice.
- Taxes may apply and are your responsibility unless we collect them.
6. Cancellation and refunds
You can cancel a subscription at any time. Cancellation stops future renewals, and your access continues until the end of the current paid period. Refunds are handled under our Refund & Cancellation Policy, which is part of these Terms.
7. Digital goods and in-game items
Purchases of the EcoEarth game and any in-game items are licenses to use digital content within the game. They have no cash value and cannot be transferred or exchanged outside the game except where the law requires otherwise. Purchases made through a third-party app store or platform are also subject to that platform's terms.
8. Physical goods
EcoStore is not yet open. When it launches, purchases of physical products will be subject to these Terms, our Shipping Policy, and the return terms in our Refund & Cancellation Policy.
9. Acceptable use
You agree not to:
- send spam or unsolicited bulk messages;
- publish or transmit unlawful, infringing, harassing, or deceptive content;
- interfere with, probe, or overload the Services, or try to access them without authorization;
- use the Services in violation of any law or regulation.
When you use Mushy Marketing, you must also follow the terms and policies of each social network you connect, including LinkedIn, X, YouTube, and Instagram.
10. Your content and posts
You keep ownership of the content you submit. You give us a limited license to host, process, and transmit it as needed to provide the Services.
You are responsible for all posts published through Mushy Marketing from your connected accounts, including posts drafted by AI agents you authorize. Review settings, approvals, and scoped keys are tools to help you, and you remain responsible for what is published.
11. Intellectual property
The Services, including our software, games, names, and logos, are owned by EcoEarth Enterprises or its licensors and are protected by law. These Terms do not grant you any rights in them except the limited right to use the Services as allowed here.
12. Third-party services
The Services connect to third-party services such as social networks and Stripe, our payment processor. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.
13. Export controls and sanctions
You may not use the Services where prohibited by U.S. law, including U.S. export control and sanctions laws. You confirm that you are not located in a sanctioned country or region and are not on any U.S. government list of restricted parties.
14. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free.
15. Limitation of liability
To the fullest extent permitted by law, EcoEarth Enterprises will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim arose.
16. Termination
You may stop using the Services at any time. We may suspend or end your access if you violate these Terms or if required by law. Sections that by their nature should survive termination will survive.
17. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
18. Changes to these Terms
We may update these Terms. If we make material changes, we will notify you by email or through the Services before they take effect. Continuing to use the Services after the effective date means you accept the updated Terms.
